British teen faces a year in UAE’s toughest prison for a holiday fling, shattering his family’s world and stirring outrage back home

In a shocking turn of events, Marcus Fakana, an 18-year-old from Tottenham, North London, has been sentenced to one year in a high-security prison in Dubai for having sex with a 17-year-old girl during a holiday. The verdict has left Fakana and his family devastated. The teenager, who was on a family vacation in the UAE, now faces what’s been described as a life-ruining sentence for an act that would have been legal in his home country.

Fakana, a construction apprentice, was arrested in August following a brief holiday romance with the girl, who is also from London. The relationship, which would have been legal in the UK, attracted the attention of Dubai authorities after the girl’s mother filed a complaint on her return to the UK. Under Dubai law, a 17-year-old is considered a child, giving rise to the charges against Fakana.

In a statement from Detained In Dubai, which represents Fakana, it was revealed that the teenager feels ‘abandoned by the British government’. The organisation has branded his sentencing as ‘an utter disgrace’ and ‘an embarrassment to Britain’. Founder Radha Stirling commented: “Here we have two British tourists who were on holiday in a consensual relationship and now one is going to jail.”

Stirling also criticised Dubai’s image as a glamorous party destination while it imprisons tourists for acts that would not be considered crimes in their home countries. She expressed disappointment at the British Government’s lack of intervention, noting that other governments have stepped up to save their citizens from unjust sentencing in similar situations.

Fakana now awaits his sentence at Al-Awir jail, also known as the Dubai Central Prison for men. This high-security facility houses some of Dubai’s most dangerous criminals, including terrorists and murderers. Since his arrest, Fakana has been unable to leave Dubai and his family has expressed deep concern over his mental health.

The case has drawn widespread attention and criticism, with many questioning the fairness of UAE law when applied to tourists. Stirling concluded with a plea to Dubai ruler HH Sheikh Mohammed Al Maktoum to “spare Marcus for consensual sex with another British citizen.”

Meanwhile, a GoFundMe page set up by the family has raised over £33,000 to cover Fakana’s legal fees and accommodation costs. The family is hoping for their son’s swift return, stating: “What was meant to be a happy time has turned into a nightmare for him, our family, and our friends.” As the legal battle continues, the fate of the young British tourist hangs in the balance.

This case highlights the stark differences between laws and cultural norms in different countries, and the potential consequences for international tourists who may be unaware of or confused by these differences. While Fakana’s actions would not have been illegal in his home country, they landed him a year-long sentence in a maximum-security prison in Dubai. This comes as a shock not only to Fakana and his family but also to the wider public, raising questions about the legal protections for tourists and the responsibilities of governments to intervene in such situations.

The reaction from Detained In Dubai, the organisation representing Fakana, underscores the growing concern around the application of UAE laws to tourists. Their criticism of the British government’s lack of intervention reflects a broader debate about the role and responsibility of governments in protecting their citizens abroad. This case could potentially influence future discussions about international travel advisories and foreign policy.

The family’s appeal to Dubai ruler HH Sheikh Mohammed Al Maktoum suggests that they are hoping for a resolution similar to past incidents where visitors have fallen foul of local laws. However, the outcome of this appeal remains uncertain.

The financial strain that Fakana’s legal battle has imposed on his family is another concerning aspect of this case. The significant funds raised through their GoFundMe page attest to the public interest and sympathy for Fakana’s situation, but also highlight the substantial costs associated with legal disputes abroad.

In conclusion, this case serves as a sobering reminder of the potential risks associated with international travel. It underscores the importance of being aware of local laws when travelling abroad and raises pertinent questions about how governments can better protect their citizens overseas.
